Frequently asked questions
How long does trademark registration take in India?
If there is no objection or opposition, around 12 to 18 months from filing. Objections and oppositions extend this. Once filed, the mark can be used with the TM symbol; the registered symbol may be used only after registration.
Can I stop someone using a name similar to my unregistered brand?
Yes, through an action for passing off, if you can show prior use, reputation in the name, and a likelihood of confusion. Registration makes enforcement considerably easier, so it should be pursued in parallel.
